TERMS & CONDITIONS AGREEMENT:
By purchasing this product, you are consenting to the following Terms and Conditions:
BIRTHPREP YOGA / POWER MAMA YOGA REFUND POLICY:
All sales for Postpartum Empowerment: Mom & Baby Yoga and gift cards are final - no refunds.
If you complete the BirthPrep Yoga - Your Roadmap to an Empowered Birth Experience course and do not feel you had an empowered birth experience post birth, a full refund will be given. You must however, have completed all course material to be eligible for a refund.
Payment for products and services by credit card will be processed in U.S. dollars at the time of payment. BirthPrep Yoga / Power Mama Yoga is not responsible for any fees, charges, exchange rates or additional charges levied by individual financial institutions or Credit Card companies.
YOUR UNIQUE LOGIN:
Your login and access to the program you purchased is for your use alone. Should you pass on your login to another user, we reserve the right to immediately remove you from the site, without a refund.
LIFETIME ACCESS TO BIRTHPREP YOGA / POWER MAMA YOGA:
Means only the lifetime of BirthPrep Yoga+ Power Mama Yoga videos (as long as the program(s) exists online). If the program(s) are removed from online (at any given time), no refunds will be given. This is the same for any product or subscription at any given time. Should the product be removed from online, no refunds will be given.
BIRTHPREP YOGA / POWER MAMA YOGA NEWSLETTER:
When you purchase, you will be subscribed to BirthPrep Yoga / Power Mama Yoga’s newsletter, with information about birth, postpartum and beyond. You can unsubscribe at any time. You may also be contacted for special guest appearances via Zoom or webinars.
LIABILITY WAIVER:
1. You assume all risks and accept sole responsibility for any injury to yourself and your unborn infant(s) if pregnant, including, but not limited to, personal injury, disability, death, illness, damage, loss, claim, liability, or expense, of any kind, that you may experience or incur in connection with your participation with BirthPrep Yoga / Power Mama Yoga Services.
2. You hereby release, covenant not to sue, discharge, and hold harmless BirhtPrep Yoga, Power Mama Yoga, Hannah Day and/or its affiliates, its employees, agents, and representatives, from liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating to participation in the Services in any medium. You understand and agree that this release includes any claims based on the actions, omissions, or negligence of BirthPrep Yoga / Power Mama Yoga and Hannah Day and/or its affiliates, its employees, agents, and representatives.
3. You agree that under no circumstances shall BirthPrep Yoga / Power Mama Yoga / Hannah Day be liable for direct, indirect, incidental, consequential, special, punitive, exemplary, or any other damages arising out of your use of the Services. Additionally, BirthPrep Yoga / Power Mama Yoga / Hannah Day is not liable for damages in connection with (i) the performance of the Services, (ii) any failure of performance, error, omission, denial of service, attack, interruption, service provider (Kajabi) ending services, deletion, defect, delay in operation or transmission, computer virus or line or system failure; (iii) loss of revenue, anticipated profits, business, savings, goodwill or data; and (iv) third party theft of, destruction of, unauthorized access to, alteration of, or use of your information or property, regardless of our negligence, gross negligence, failure of an essential purpose and whether such liability arises in negligence, contract, tort, or any other theory of legal liability. The foregoing applies even if BirthPrep Yoga / Power Mama Yoga / Hannah Day has been advised of the possibility of or could have foreseen the damages.
4. You shall indemnify and hold BirthPrep Yoga / Power Mama Yoga / Hannah Day & any guest speakers harmless from and against any and all losses, damages, settlements, liabilities, costs, charges, assessments and expenses, as well as third party claims and causes of action, including, without limitation, attorneys’ fees, arising out of any breach by you of any of these Terms and Conditions.
INTELLECTUAL PROPERTY:
The Site contains intellectual property created by BirthPrep Yoga / Power Mama Yoga / Hannah Day including, without limitation, trademarks, copyrights, proprietary information and other intellectual property as well as the BirthPrep Yoga name, logo, all designs, text, graphics, photographs, other files, and the selection and arrangement thereof.
You may not modify, publish, transmit, participate in the transfer or sale of, create derivative works from, distribute, display, reproduce or perform, or in any way exploit in any format whatsoever any of the Site content or intellectual property, in whole or in part without our prior written consent obtained from BirthPrep Yoga. We reserve the right to immediately remove you from the Site, without refund, if you are caught violating this intellectual property policy.
TERMS AND CONDITIONS ACCEPTANCE:
This Agreement shall be governed by and construed in accordance with the laws of the Province of British Columbia and the applicable laws of Canada, regardless of the conflict of laws principles thereof.
Should you continue with your purchase, you have read this agreement carefully and acknowledge that you have complete knowledge and understanding of its contents.
